The following are the terms of trade of “Skydive Australia” (“SA”)
The Terms and Conditions may only be varied by agreement in writing between Skydive Australia and the Agent and these conditions may not be waived by any one party.
Parties
- “Skydive Australia” (ABN 32 641 753 648 ) of 5/89 York Street, Sydney, Australia 2000 (“SA”)
- “Agent” whose details are set out in the ‘Acceptance of Rates and Terms & Conditions’ section below.
- “Guest” means person or persons who has been identified as the end user of the booked Skydive Product or Skydive Add-On.
Relationship of Parties
- The relationship between the parties is an agency relationship for the limited purpose of the Agent offering Skydive Australia Products to potential Guests under the terms and conditions.
- SA agrees to allow the Agent to sell Skydive Products and Add-Ons to Guests, in the capacity as agent for SA, on these Terms and Conditions.
Agent Application Form
New Agents wishing to sell or promote Skydive Australia products must complete an Agent application form prior to accessing rates and making bookings.
SKYDIVE AUSTrALIA BOOKINGS
1. When the Agent sells a tandem skydive, it is the Agent’s responsibility to clearly communicate the SA terms and conditions to the Guest and ensure their understanding and acceptance. Should the Agent fail to disclose any part of the SA booking conditions, SA is entitled to recover the cost from the Agent arising from any incorrect disclosure, including the cost of any compensation paid to the customer.Full terms and conditions here

2. SA will provide a Booking reference to the Agent upon confirmation of booking.
3. The Agent must provide the Guest with a receipt of payment, a voucher or confirmation document which must be presented upon check-in at SA's drop zone. Without this document, customers may be charged full price for their skydive and will be instructed to obtain a refund through The Agent. Details to include:
- SA Booking Reference
- Agent Booking ID/voucher number
- Guest first and last name
- Product and add-on details
- Link to SA’s FAQs page
- Booking Terms and Conditions
Availability of Jump Dates & Time Slots
All jump dates and times are subject to availability at time of booking. Check availability and days of operation either on the Skydive Australia website or with the SA reservations team, prior to confirming a booking on behalf of the customer.
Location & Duration of a Tandem Skydive
Note that all bookings are given an ‘arrival/check-in’ time only. Please note this is not a skydive ‘jump’ time. Whilst SA endeavours to complete an individual’s tandem skydive within 4 hours of arrival, SA advises arriving with no time constraints, and should plan for this to be a whole day’s activity. As safety is SA’s main concern, factors such as wind, cloud, rain, thermal turbulence etc. and other factors such as air traffic can affect the time it takes to complete the skydive activity. Weather can change for better or worse in minutes, and customers will be unable to skydive unless they are at SA’s Drop Zone. The location of the landing area for each parachute drop may vary depending on weather conditions, with the focus being on customer safety. Refunds or compensation will not be made if a spectator does not witness a landing.
Group Bookings
While SA endeavours to keep groups in the same load, SA does reserve the right to change group configurations where necessary due to operational requirements. No refunds will be made available where SA changes your group configuration. Group rates available on application.
Online Check-in Form (APF Registration)
Wherever possible, all customers must complete an online check-in form including pre-registration with the Australian Parachute Federation (APF) before arriving at the drop zone. Links to the online check-in form may be found on the confirmation email, emailed or sent via a text message prior to arrival, or on a mobile device on arrival at the skydive drop zone. All documents must be completed by the Guest and not the Agent, prior to skydiving. A safety briefing and gear-up must be completed by the Guest on arrival.
SALES RATES
- The Agent agrees to sell Skydive Australia tandem skydives and add-ons at the Sell Rates contained in the latest Rates Sheet
- Any changes in Sell Rates will be advised to agents at the earliest opportunity and reflected in the Rate Sheet.
- Australian Parachute Federation (APF) Membership is mandatory for all tandem skydive customers. The APF membership levy is included in the Sell Rates.
- Personal Accident Insurance (PAI) is mandatory and included in the Sell Rates.
- All Sell Rates are inclusive of Australian GST and are subject to change at Skydive Australia's discretion.
- Agents must confirm the validity of a rate, either online or with the SA reservations team, prior to confirming the final cost to the customer.
AGENT COMMISSION
1. Commission:- the amount the Agent is entitled to receive
- payable on completion of the skydive
- not payable on cancelled bookings
- only payable on the skydive product and not on any add-ons including Photo & Video packages, and merchandise.
- is confidential and Agents must agree not to disclose this information to any other person.
- may be reviewed at Skydive Australia's discretion with a minimum of 2 weeks’ notice.
PAYMENT POLICY
- The Agent agrees to pay SA in accordance with the Payment Policy.
- Full payment is required at the time of booking for Agents without a credit account with Skydive Australia.
- Payment is required in full within 30 of invoice date for Agents with a credit account with Skydive Australia.
- All payments are non-refundable.
- Payments not received by the due date may result in the cancellation of the booking.
- Credit card payments processed at the Skydive Australia drop zones will attract credit card surcharges which are subject to change and are non-refundable.

CANCELLATION & AMENDMENT POLICY
By the guest
- Notice of a cancellation must be provided by email to SA Reservations. Any Cancellations inside 24 hours, including customers who do not show at the drop zone on the jump date, will result in 100% cancellation fee.
- A booking may be rescheduled any number of times, however the booking will only remain valid for a period of 12 months from the original jump date and must be booked on the same Sell Rate. If the Sell Rate has increased due to change in Season, Day of Week or general price increase the difference will need to be collected.After this date, all payments will be forfeited, and no refunds will be given.
- Amendments to a scheduled jump date may be made up to 24hrs prior to travel with no fees incurred. Amendments are not allowed inside 24hrs to jump.
- Name changes must be provided by email to SA Reservations and will not incur a fee.
- If Guests change their mind, all payments will be forfeited, and no refunds will be given should they fail to go through with a skydive or decide to change to a different skydive product of lesser value.
By Skydive Australia
- To ensure the highest standards are maintained, SA reserves the right to reschedule or alter a tandem skydive with no prior notification. These changes do not constitute a claim for a refund and include changes to type of aircraft used, drop zone, check in time, jump time, number of participants in a plane, altitude reached, duration of free fall and location. Providing customers with a 100% safe and amazing experience is our number one focus.
- If a skydive is cancelled due to weather, SA will endeavour to rebook the jump on a suitable alternative date before leaving the drop zone. The Guest may also rebook at an alternative Skydive Australia drop zone location. If the location change is of a lesser retail amount SA will refund the difference, however if the new Skydive retail price is greater than $50 the guest must pay the difference. If the guest is changing to an experience of a higher booking value including upgrading to a higher jump height, changing to a weekend and public holiday, changing products, packages or skydive locations. Customers will not be due a refund if changing to an experience of a lesser booking value.
- If the Guest is unable to jump on an alternative date, reschedule or transfer to another SA Dropzone, a refund will be issued. If the booking is not direct to SA then guests must go back to their booking agent in these instances, as agent terms and conditions vary.
TRAVEL INSURANCE
We strongly recommend all Guests to purchase their own travel insurance to cover possible unforeseen circumstances.
PUBLICATION OF SKYDIVE AUSTRALIA PRODUCTS & BRAND ASSETS
- Prior to publishing any offers or advertisements of SA products, offline or online, the agent must obtain written approval from SA of the content, form and creative of the proposed offer or advertisement. SA reserves the right to restrict which products may be offered or advertised by the agent and the basis or way in which the products are offered or advertised, including in relation to rates, special offers, currency, and the representation of products.
- The agent must obtain written approval from SA, granting the agent a licence for any offline or online use of SA brand assets, including trademarks, logos and brand images.
- Copy, images and video footage, produced by SA is available on request
DIGITAL CONFLICT OF INTEREST
- The Agent must agree not to participate in Metasearch programs by paying to display rates for Skydive Australia products. Metasearch refers to lead generation platforms and websites that provide consumers the ability to comparison shop across multiple online travel agents and SA’s own online booking engine rates. These include, but are not limited to, Trip Advisor, Trivago, Google Hotel Price Ads, Kayak, Google Places, Google Hotels, Finder, Skyscanner and Google Maps.
- The Agent must agree not to bid on any businesses, brand names and specific locations which these businesses operate in and any exact or variation of the Primary Keyword Phrases, including common misspellings, abbreviations or change in word order, in any form of paid advertising or search engines. This also applies to all combinations where the word ‘skydive’ is substituted for ‘skydiving’.
- The Agent must agree not to use any of the Business Names, Primary Keyword Phrases listed below, or SA images in page/profile names, usernames, signatures, avatars and profile shots within social media or buy, or own any domain names that contain Primary Keyword Phrases in the URL.
- The Agent agrees to not use these Businesses, Brand Names and Locations in ad text or display URLs, nor shall the agent place social media adverts (Eg. On YouTube, Facebook or other channels) in a way that targets, competes or confuses users as to the origin/ownership of the activities.
- SA reserves the right to revoke this agreement if changes are not made to ads that we believe are not in compliance with this criteria.
Digital Advertising - Keyword Bidding
Should the agent run digital campaigns that incorporate Skydiving in Australia and be in a location where Skydive Australia does not have a direct ‘tandem skydiving’ competitor, we require that the following combinations are placed as ‘negative keywords’ and ‘negative keyword combinations’ in search term campaigns. The agent should also mark common misspellings of these words as negative.

SOCIAL MEDIA POLICY
Social Media means a web or mobile-based application that allows or facilitates the creation and exchange of user-generated content including, but not limited to, Facebook, YouTube, Twitter, Instagram, Pinterest, Snapchat, Reddit, Tumblr, LinkedIn, Qzone, Weibo, WeChat, Ask.fm, Flickr, VK, Odnoklassniki and Meetup. Agents agree not to create official or unofficial pages/profiles on Social Media sites that are primarily used to promote SA products without express written permission; nor post comments to forums, blogs, Social Media or review sites that insinuate that the agent is an official representative of the SA business.
PROTECTION & PRIVACY POLICY
SA has implemented in accordance with all the applicable data protection, the necessary organisation and technical security measures within their scope to guarantee personal data protection, and avoid its alteration, loss, illegal use and non-authorised access. Acceptance of Rates and Terms & Conditions
- Any act by the Agent to sell Products and Add-ons to a Guest, confirming a booking or authorising payment will be deemed to be acceptance of the terms and conditions set out in this Agreement.
- The Agent acknowledges that failure to keep within the terms stated in this document may result in the temporary or permanent withdrawal of their account with the Company.
- The Agent is liable for all legal and related incidental costs incurred by the company in the recovery of all amounts owing as a result of any breach of this agreement.
- Agents must agree to further indemnify SA, its associate companies, directors and associates against any risk or action related to your participation in your skydive.
- SA is not obligated to fulfil any products and add-ons where the Agent has failed to comply with their obligations under this Agreement.
